What is assault?
In Maryland, the crime of assault encompasses what was known at common law as “assault and battery.” It includes a threat of violence as well as any unwanted touching. Actions such as hitting, kicking, punching or pushing are clearly assaults, but other actions and even words can be considered assault if they intentionally put another person in fear of being harmed.
What are some types of assaults?
Many assault charges stem from simple fights. In these cases, our attorneys work to show that you were acting in self-defense and are not a violent criminal. Reducing an assault charge
Depending on the facts of your case, the state may choose to charge you with a higher level crime than is justified. In Maryland, first degree assault consists of causing serious physical injury to another individual or wielding a firearm or other dangerous weapon, whether or not it is used. This is a felony punishable by up to 25 years in prison. By contrast, second-degree assault — intentionally causing physical injury or an impairment of another person’s physical condition — carries up to 10 years imprisonment, or a longer sentence if the victim is a law enforcement officer. I will work to get your charges reduced, sometimes to lesser offenses like reckless endangerment or even disorderly conduct.
