What is assault?

In Maryland, the crime of assault encompasses what was known at common law as “assault and battery.” It includes a threat of violence as well as any unwanted touching. Actions such as hitting, kicking, punching or pushing are clearly assaults, but other actions and even words can be considered assault if they intentionally put another person in fear of being harmed.

What are some types of assaults?

This is a felony punishable by up to 25 years in prison. By contrast, second-degree assault — intentionally causing physical injury or an impairment of another person’s physical condition — carries up to 10 years imprisonment, or a longer sentence if the victim is a law enforcement officer.
